Candriam Privacy Notice for job applicants

Introduction
Candriam, a Luxembourg société en commandite par actions (partnership limited by shares) (registered office: Serenity - Bloc B, 19-21 Route d’Arlon, L-8009 Strassen, Luxembourg), its branches, subsidiaries and Candriam Switzerland (registered office: rue du 31 décembre 40-42, CH-1207 Geneva, Switzerland) (“Candriam” or “we” or “us”) are committed to respecting the personal data (“Personal Data”) of Candriam job applicants.
For the purposes of the applicable personal data protection legislation (including among others, the General Data Protection Regulation (EU) 2016/679 (hereinafter the “GDPR”), the Dubai International Financial Centre Data Protection Law (DPL) and the Swiss Federal Data Protection Act, amended or replaced from time to time and to the extent applicable), Candriam acts as a “data controller” in relation to the collection, use and processing of your Personal Data as part of the recruitment process.
Candriam Switzerland has appointed Candriam, a société en commandite par actions (partnership limited by shares) with registered office at Serenity - Bloc B, 19-21 Route d’Arlon, L-8009 Strassen, Luxembourg, registered with the Luxembourg Trade and Companies Register under number B 37647 as its representative within the European Union for the application of the GDPR.
Applicants’ Personal Data will be processed and included in internal and external files and systems controlled by Candriam for the purpose of managing the application process and as further described in this information notice (the “Notice”).
You acknowledge that you have carefully read this Notice and have unreservedly accepted it. You also acknowledge that you have understood the purposes and grounds on which your Personal Data are processed. You acknowledge that continued use will be considered to represent continued consent.
In case of doubt on the interpretation of the present Notice, the French version will prevail over the other versions.
- Collection of Personal Data concerning applicants
- Candriam collects and processes the following categories of Personal Data concerning job applicants, provided that such data are adequate, relevant and limited to what is necessary for the purposes for which they are processed. We may obtain the Personal Data you have provided by submitting your application for employment with Candriam directly or through a recruiter. Such Personal Data may include, but are not limited to:
- Identification and contact data: name, contact details (home address, telephone, fax and email address), interests and goals, gender, nationality, sound/voice/image recording.
- Professional data: names of previous employers, names, titles and contact details of references, details of your academic background (including professional qualifications/certifications) and curriculum vitae (CV).
- Please ensure that you do not provide any “sensitive” Personal Data in the recruitment process, i.e., information about your ethnic origin, political opinions, religious beliefs, trade union membership, health status, sexual orientation or criminal convictions. If such information is required as part of the recruitment process, and in particular information about any criminal convictions and offences, we will inform you at the appropriate time and ask for your consent.
- Please ensure that you have the authorisations of the Candriam employee or other referee whose details you provide at the time of application for us to use their Personal Data as set out in this Notice.
- Please note that all Personal Data collected during the recruitment process will be transferred to Candriam’s files and systems. Regardless of the outcome of the application process, the processed Personal Data will be deleted within a reasonable period of time after the application process, in accordance with our obligations and in compliance with our applicable rules on the retention of Personal Data.
- Verification of information provided by applicants
- For some positions, the information you provide at the time of application and during the recruitment process will need to be verified (e.g., identity, academic qualifications and/or professional experience) and pre-employment checks may be carried out (e.g., on possible criminal convictions and offences or on the applicant’s financial situation). The scope of the checks will depend on the role/position to be filled. Please note that these checks may take place at any time and, in particular, at the end of the recruitment process. Further controls and checks may also take place after you have been selected for the position in question. If your application is successful, we will inform you and ask for the necessary authorisations before carrying out these checks.
- Purposes of processing
- The legal bases of our Personal Data processing activities are established within the strict limits of the purposes and conditions of Articles 6, 9 and 10 of the GDPR. If your Personal Data is processed on the basis of your consent or a legitimate interest, you may object to this processing at any time. This objection must be sent by email to the email address stated at the end of this Notice
- Candriam collects and processes applicants’ Personal Data for the following purposes:
- To conclude and execute your employment contract;
- To carry out our business and pursue our legitimate interests, including: making informed decisions that may lead to a job offer, checking your suitability for the job, keeping your profile for other vacancies, responding to your queries as best we can, improving our recruitment procedures and practices, managing our IT systems and for the administration of Candriam;
- To comply with applicable laws and to protect our legitimate business interests and legal rights, including, without limitation, in connection with legal claims, to ensure compliance, to comply with applicable regulations, in connection with investigations or disciplinary proceedings (we will also disclose such information in connection with legal proceedings or litigation). This includes checking that you have the right to work in the country in which you are applying for a job with Candriam.
- As mentioned above, we may ask for your consent to conduct background checks when required by your job. Where the processing of your Personal Data is based on your consent, it may be withdrawn at any time.
- If you are asked to provide additional information for verification purposes, we will clearly inform you of this at the time of collection and explain what will happen if you do not provide the required information.
- Some of these purposes may be based on the legitimate interests of Candriam, its subsidiaries and/or affiliates in the management and marketing of their business considered by Candriam not to be contrary to the interests, freedoms, rights and fundamental rights of the applicants (given that if Candriam cannot carry out certain processing operations, the impact on its business may be high and the identified risks of harm to the interests of the individual are unlikely to materialise). If these risks materialise, Candriam has put in place sufficient guarantees in order to mitigate their impact.
- Disclosure of applicants’ Personal Data
- Your Personal Data may be disclosed to:
- Subsidiaries, branches and/or affiliates;
- Trusted third parties used by Candriam in the recruitment process, such as background checks, psychometric tests, average score calculations and assessments;
- Other third parties who provide services on our behalf such as professional advisors and/or IT consultants who manage our IT systems;
- Governmental and/or legal or regulatory authorities as necessary for the purposes listed above to the extent permitted or required by applicable legal or regulatory obligations or as necessary to lawfully protect our legitimate interests in compliance with applicable laws;
- Our advice, to the prospective purchaser and to the prospective purchaser’s counsel if we are sold to or taken over by another company.
- The Personal Data will only be disclosed within the framework of the legal basis used for the processing of the Personal Data in question, with contractual guarantees that the Personal Data remain secure and confidential.
- International transfers of applicants’ Personal Data
- In exceptional cases, we may transfer your Personal Data to countries outside the European Union whose laws do not provide for a level of protection of Personal Data equivalent to that provided by the country of origin.
- In order to ensure that such transfers are adequately protected, Candriam uses transfer mechanisms recognised by the European Commission, which may include the appropriate entry into standard contractual clauses approved by the European Commission pursuant to Article 46 (2) of the GDPR. - Retention of applicants’ Personal Data
- Candriam will not retain applicants’ Personal Data for longer than is necessary to carry out the purposes set out in this Notice or to comply with a legal obligation imposed by applicable laws. - Your rights
- Unless otherwise provided for in the GDPR or any other applicable legal provision on the protection of personal data, as a data subject, applicants have a number of rights regarding the use of their Personal Data:
- Access: You have the right to obtain confirmation that your Personal Data are or are not being processed and to obtain access to these data and to receive certain additional information such as the purpose of the processing, the categories of data in question, etc. You have the right to request a copy of the Personal Data we hold about you. Please note that there are exceptions to this right. You may be denied access to your Personal Data if, for example, making them available to you involves disclosing the Personal Data of a third party, or if we are prohibited by law from disclosing such information. - Accuracy: We strive to keep your Personal Data up to date and to ensure that they are accurate and complete. We invite you to contact us at the email address provided at the end of this Notice to notify us about any inaccurate Personal Data or changes so that we can update your Personal Data.
- Withdrawal: You have the right to withdraw your previous consent to the processing of your Personal Data. You may withdraw your consent at any time by sending an email to the email address provided at the end of this Notice.
- Objection: In some cases, you also have the right to object to the processing of your Personal Data.
- Limitation: In some cases, you also have the right to restrict the processing of your Personal Data.
- Erasure: In some cases, you also have the right to have your Personal Data erased.
- Portability: You have the right to request that some of your Personal Data be transferred to you or to another data controller, in a commonly used and machine-readable format.
- Complaints: If you consider that your data protection rights have been breached, you are entitled to lodge a complaint with the competent supervisory authority or to appeal to a court.
- Please note that there are exceptions to these rights if, for example, we are legally required to continue processing your Personal Data.
- Please note that you will be notified of any rectification or erasure of Personal Data or restriction of processing unless such notification proves to be impossible or requires a disproportionate effort.
- If you wish to submit a request to exercise one or more of the rights listed above, you should send an email to the email address provided at the end of this Notice. This request must clearly state which right you wish to exercise and, where applicable, the reasons for exercising the right.
- We will promptly notify you when your request is received. If the request is valid, we will comply with it as soon as reasonably possible and, in any event, within one (1) month of receiving the request. Otherwise, we will inform you of the reasons for refusal within one (1) month of receiving the request.
- When we ask you for Personal Data, we will use every effort to make it clear to you whether such data are necessary or optional. You are obliged to inform Candriam of any modification of the Personal Data or any inaccuracy in the same.

- Although Candriam hopes to be able to answer any questions that candidates may ask, if your issues are not resolved, you also have the right to complain to the data protection authorities. The competent data protection authority will be the supervisory authority in the country in which Candriam operates.
